These Terms of Service (“Terms”) apply when you visit, browse, or purchase from the StormStreams Merch website at https://stormstreams.org (the “Store”).

The Store is operated by StormStreams Merch (“we,” “us,” or “our”) and is powered by Shopify. By accessing the Store or placing an order, you agree to these Terms. Nothing in these Terms limits the statutory rights available to consumers under applicable law.

StormStreams Merch is an online merchandise retailer operating from the United Kingdom.

2. Eligibility

By using the Store, you confirm that you are legally capable of entering into a contract or that you have permission from a parent or legal guardian.

You must provide accurate, complete, and current information when placing an order or creating an account.

3. Products

We make reasonable efforts to describe and display products accurately. Colours and appearance may vary depending on your screen, device settings, printing process, garment material, or manufacturing batch.

Measurements and size guides are approximate. You are responsible for reviewing the relevant product description and size information before ordering.

Some products are manufactured or printed after an order is placed and fulfilled by third-party print-on-demand providers.

We may change or discontinue products when reasonably necessary. Changes will not affect orders we have already accepted unless we contact you and agree otherwise.

4. Prices and Payment

Prices are displayed in the currency shown at checkout. Applicable taxes, delivery charges, and other required charges will be displayed before you submit your order.

We may change prices at any time, but a price change will not affect an order we have already accepted.

If a product or price is displayed incorrectly, we may reject or cancel the affected order before dispatch. If payment has already been taken, we will issue a full refund.

Payment is processed through Shopify and its payment-service providers. We do not directly store complete payment-card details.

5. Orders and Contract Formation

Submitting an order is an offer to purchase the selected products.

An automated order acknowledgement confirms that we received your order but does not necessarily mean that we accepted it. A contract is formed when we send confirmation that the order has been accepted or dispatched.

We may reject or cancel an order for legitimate reasons, including:

A product being unavailable.
Incorrect product or pricing information.
Payment not being authorised.
Suspected fraud or unlawful activity.
Delivery not being available to the supplied address.
A breach of these Terms.

If we cancel an order after taking payment, we will refund the affected amount.

6. Order Changes and Cancellations

Orders can enter production shortly after being placed. Contact us as soon as possible if you need to change or cancel an order.

We cannot guarantee that an order can be changed after production or fulfilment has started. This does not affect any cancellation or consumer rights that apply by law.

Any cancellation feature offered immediately after checkout is an additional convenience and does not replace your statutory rights.

7. Delivery

Delivery estimates are provided in good faith but are not guaranteed delivery dates unless expressly agreed otherwise.

Delivery times may be affected by production time, customs processing, carrier disruption, weather, incorrect address information, or other circumstances outside our reasonable control.

Unless a different timeframe has been agreed, UK consumer orders will be delivered within the period required by applicable law.

You are responsible for providing a complete and accurate delivery address. Contact us immediately if you notice an error. We cannot guarantee that an address can be changed after fulfilment begins.

Risk in goods passes to a consumer when the goods are delivered to the consumer or a person identified by the consumer, except where the consumer independently arranged a carrier that we did not offer.

8. Returns, Cancellations, and Refunds

Our Return and Refund Policy forms part of these Terms.

Where UK distance-selling rules apply, consumers generally have the right to cancel an eligible order without giving a reason by notifying us within 14 days after receiving the goods. After notifying us, the consumer generally has another 14 days to return them.

Exceptions may apply to goods made to a customer’s specifications or clearly personalised. A product is not necessarily excluded from cancellation rights merely because it was produced after the order was placed.

The cancellation right does not affect your rights where goods are faulty, damaged, not as described, or otherwise fail to meet legal requirements.

Do not return an item without contacting us first. We will provide the appropriate return instructions and return destination. Products may need to be returned to a fulfilment provider rather than our business contact address.

9. Faulty, Damaged, or Incorrect Products

Products must be as described, of satisfactory quality, and fit for purpose as required by applicable consumer law.

If a product arrives faulty, damaged, misprinted, or incorrect, contact us promptly at stormstreams1412@gmail.com with:

Your order number.
A description of the problem.
Clear photographs showing the product and issue.

We will assess the issue and provide an appropriate remedy, which may include a replacement, repair, price reduction, or refund. Nothing in these Terms excludes your statutory remedies.

10. Intellectual Property

All content available through the Store—including branding, logos, graphics, product designs, photographs, videos, text, and website content—is owned by or licensed to StormStreams Merch unless stated otherwise.

You may use the Store only for personal, non-commercial shopping purposes. You must not copy, reproduce, modify, distribute, sell, license, scrape, or commercially exploit Store content without prior written permission.

11. Reviews and User Content

If you submit a review, photograph, comment, or other content, you confirm that:

You have the right to submit it.
It is accurate to the best of your knowledge.
It does not infringe another person’s rights.
It is not unlawful, abusive, defamatory, deceptive, or malicious.

You give us a non-exclusive, worldwide, royalty-free licence to display and use that content in connection with the Store and our products, subject to applicable privacy and consumer law.

We may moderate or remove content where reasonably necessary.

12. Acceptable Use

You must not use the Store:

For unlawful or fraudulent activity.
To infringe intellectual-property or privacy rights.
To transmit malware or harmful code.
To interfere with the Store’s security or operation.
To collect information about others without authority.
To submit false, misleading, abusive, or malicious material.
To attempt unauthorised access to accounts or systems.

We may restrict access where reasonably necessary to protect customers, the Store, or third parties.

13. Third-Party Services

The Store may use or link to services operated by Shopify, payment providers, fulfilment providers, carriers, social networks, or other third parties.

Third-party services may have their own terms and privacy policies. We are not responsible for unrelated content or services controlled solely by third parties, but this does not remove any responsibility we have to you under consumer law for fulfilling our contract.

14. Privacy

Our collection and use of personal information are described in our Privacy Policy. Shopify also processes information as described in its own privacy notices.

15. Store Availability

We aim to keep the Store available and accurate, but we do not guarantee uninterrupted or error-free access.

We may temporarily suspend or restrict parts of the Store for maintenance, security, technical, or operational reasons. This does not affect rights relating to orders already accepted.

16. Liability

Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability for:

Death or personal injury caused by negligence.
Fraud or fraudulent misrepresentation.
Faulty goods or goods that are not as described.
A breach of rights that cannot legally be excluded.
Any other liability that cannot be limited under applicable law.

We are not responsible for losses that were not reasonably foreseeable when the contract was formed.

If you use products or the Store for business purposes, we are not responsible for business losses such as lost profits, revenue, opportunities, or data, except where liability cannot legally be excluded.

17. Changes to These Terms

We may update these Terms to reflect changes to the Store, our practices, or applicable law.

The version in effect when we accept your order will normally govern that purchase. Updated Terms will be posted on this page with a revised “Last updated” date.

18. Governing Law

These Terms are governed by applicable UK law.

If you are a consumer, you retain any mandatory protections provided by the law of the country in which you live. Nothing in these Terms prevents you from bringing a claim in a court available to you under applicable consumer law.

19. Severability

If any part of these Terms is found to be unlawful or unenforceable, the remaining provisions will continue to apply.

20. Entire Agreement

These Terms, together with our Privacy Policy, Return and Refund Policy, Shipping Policy, Contact Information, Legal Notice, and any information presented at checkout, form the agreement between you and StormStreams Merch concerning your purchase.
